Having Officially Earned the Title of Doctor, Humaeroh Delves into the Phenomenon of Parental Custody at Daycare from an Islamic Legal Perspective

UIN Sultan Maulana Hasanuddin Banten’s Doctoral Defense Proceedings Conducted with Reverence and Inspiration

Serang – The second-floor postgraduate auditorium at the State Islamic University of Sultan Maulana Hasanuddin (UIN SMH) Banten bore witness to a historic moment for Humaeroh (Student ID 21361104), a candidate in the Doctorate Program in Islamic Family Law. On Saturday, July 19, 2025, Humaeroh successfully attained her doctoral degree following the defense of her dissertation entitled:

“Parental Daycare in the Banten Province Nursing Home in the Perspective of Islamic Law (Study on Child Maintenance and Dedication to Parents)”

The session was presided over directly by Professor Dr. Wawan Wahyudin, M.Pd, serving as Chair, with Professor Dr. Naf’an Tarihoran, M.Hum, acting as Secretary. The promoter was Professor Dr. M. A. Tihami, M.A., M.M., accompanied by co-promoter Dr. Ahmad Hidayat, Lc., M.A.

The examining panel comprised distinguished senior academics and experts in their respective fields, namely:

  • Professor Dr. Faridatul Fauziah, M.Hum 
  • Professor Dr. Zakaria Syafe’i, M.Pd 
  • Dr. Ahmad Zaini, M.Si 
  • Professor Dr. Ilzamudin Makmur, M.A

At the outset of the session, the Chair delivered a brief opening address, followed by the reading of the procedural guidelines by the Secretary. The promoter then introduced the doctoral candidate to all attendees, proceeding with the presentation of the dissertation.

During her presentation, Humaeroh elucidated that the phenomenon of parental custody at Werdha Homes does not merely reflect children’s negligence regarding filial duties and financial support. Rather, in the context of modern society, such decisions are often driven by various factors, including traumatic past experiences, emotional and financial circumstances, and the readiness of the care facility to meet the physical and psychological needs of the elderly.

The research demonstrated that from the perspective of Islamic Law, particularly through the Maqashid Syariah approach, entrusting parents to Daycare does not inherently conflict with religious values, provided that children continue to fulfill their maintenance obligations and uphold their parents’ dignity and welfare.

This presentation sparked vibrant, critical discussion among the examiners. Each panelist posed incisive yet constructive questions and scholarly remarks, reflecting the depth of the dissertation’s inquiry and the sharpness of the Promovenda’s reasoning.

Following the panel’s questions, the session was temporarily adjourned for evaluation. Upon resumption, the Chair announced with pride that Humaeroh had passed with commendation and was thus officially entitled to bear the title of Doctor in Islamic Family Law.

In his closing remarks, Professor Dr. Wawan Wahyudin, M.Pd, expressed profound appreciation for Humaeroh’s academic achievement. He also conveyed three meaningful messages, which he referred to as the three “mothers” that must always be cherished and honored:

  • The Biological Mother, as the epitome of love, sacrifice, and prayers that underpin one’s life.
  • Motherland (Ibu Pertiwi), (homeland) that must be protected and defended through knowledge, integrity, and tangible contributions to humanity and the nation.
  • Teachers and Mentors, the educators and guides in knowledge who deserve respect and should always be remembered in prayers as part of the etiquette and blessing of learning.

In a heartfelt response, Humaeroh expressed her gratitude to the examiners, promoters, family, and all parties who had been part of her scholarly journey. She also reaffirmed her determination to continue working and serving through the knowledge she had acquired.

This achievement is further distinguished by the fact that Humaeroh ranks as the fifth graduate from the Islamic Family Law Program and the twenty-seventh doctoral graduate of UIN SMH Banten’s postgraduate program.

This doctoral defense marked the culmination of a long academic voyage and the dawn of Humaeroh’s scholarly dedication to developing relevant, humane, and problem-solving Islamic family law in response to contemporary challenges.
